Data protection at Independent Credit View AG

I-CV is committed to the protection and safekeeping of personal data from its current, future and former customers (hereinafter “customers”, “you”, “you”) in accordance with applicable law, in particular the Swiss Data Protection Act (hereinafter “DSG”) and, where applicable, the European General Data Protection Regulation (hereinafter “GDPR”). This Privacy Policy (“Policy”) describes the ways in which we may collect, use or process personal information, among other things, and disclose it in certain circumstances.

I-CV will not collect or require the disclosure of sensitive personal data (such as ethnic origin, religion or medical data). However, if you choose to provide such sensitive personal data, I-CV may assume that such sensitive data has been provided with your consent and may be processed as I-CV deems appropriate, unless you notify I-CV otherwise in writing.

1.2 Data security

I-CV transfers and stores your personal data in a protected environment. We will take all reasonable steps to prevent third parties not engaged by I-CV to provide services to you from gaining access to your personal information. We will only pass on your data to other third parties if we are forced to do so for legal, official or regulatory reasons. We will not share any information about you with others unless we believe it is lawful or you have given us your consent.

1.3 Outsourcing

I-CV has transferred the archiving of company data to a specialized third party company. Outsourcing is limited to the encrypted archiving of data. The data will be processed exclusively within the company.

1.4 Data transmission

I-CV will not disclose any personal information collected from you to any third party except: (i) as required by applicable law or regulation; (ii) where there is a general obligation to disclose; (iii) where I-CV’s legitimate business interests require disclosure; or (iv) at your request or with your consent or to the persons described below.

I-CV may, subject to applicable law, disclose personal information about you to persons or entities that provide services to I-CV or act as an agent of I-CV, and to any person to whom I-CV assigns or offers to assign its rights or obligations under the Terms of Use of the Site, or who assists with identity checks and fraud prevention or credit checks, subject to applicable law.

1.5 Data protection on the Internet

At I-CV, various security regulations apply to ensure the protection of your personal data. However, I-CV assumes no responsibility or liability for the security of your data while it is transmitted to us via the Internet. In order to protect your privacy, we would like to remind you that you can also contact us via other means of communication if you consider this appropriate.

The website may contain hyperlinks to websites of third parties that are not operated or controlled by I-CV. When you leave our website, I-CV is not responsible for the content or privacy practices of third party websites.

1.6 Recording and monitoring

I-CV may record or monitor telephone conversations and e-mail correspondence between you and I-CV for security, compliance, and to maintain and improve the quality of I-CV’s services.

2. Legal basis for the processing of personal data

I-CV processes personal data in accordance with the provisions of the Swiss DSG and – where applicable – the European GDPR. The lawfulness of the processing of the data results in particular from Art. 6 GDPR.

The processing of personal data at I-CV is based on:

  • contractual agreements and serves the fulfilment of contractual obligations between you and I-CV. This also applies to processing operations which are necessary for the implementation of pre-contractual measures.
  • a legal obligation subject to I-CV.
  • Your consent by your use of the Internet pages and the Research Portal of I-CV.
  • the protection of a justified interest of I-CV or a third party, whereby the interests, fundamental rights and fundamental freedoms of you do not outweigh the interest of I-CV or the third party.

3. Duration of storage

Personal data is processed or stored for as long as is necessary to achieve the purpose for which it was collected and to fulfil contractual or statutory obligations. Storage can also take place if this is provided for by national or international law applicable to I-CV (statutory storage and documentation periods).

The data will be blocked or deleted even if a storage period prescribed by the applicable legal standards expires, unless it is necessary for further storage of the data for the conclusion or performance of a contract.

B. Use of cookies

Our website uses cookies. Cookies are text files that are stored in the Internet browser or by the Internet browser on the customer’s computer system. C. E-mail contact and online contact forms

When contacting I-CV, the required legitimate interest in the processing of data from I-CV lies in the processing of the contact. Other personal data processed serves to ensure the security of our information technology systems.

If you contact us, you can object to the storage of your personal data at any time (see below “E. Customer’s data protection rights”). In such a case, the communication cannot be continued.

On our website there is a contact form which can be used to establish electronic contact. If a user chooses this option, the data entered in the input form will be transmitted to us and stored. Typical data collected are e.g. company, name, postal address, e-mail address, concerns, etc. The data will not be passed on to third parties.

Your consent will be obtained for the processing of the data as part of the sending process and reference will be made to this data protection declaration.

D. marketing emails

For information purposes, I-CV sends out marketing e-mails (e.g. newsletters, event invitations, etc.). By using such marketing emails, you consent to the processing of information collected about you in the manner and for the purposes described in this Policy. Recipients may opt out of receiving such marketing emails at any time by notifying us by emailing info@I-CV.ch

E. Data protection rights of the customer

If the relationship between you and I-CV falls under the GDPR and you process personal data, you are the data subject within the meaning of the GDPR. The assertion of the following rights depends on the legal basis chosen for the storage of personal data. The GDPR grants each data subject a right of access, a right to rectification or deletion, a right to limitation of processing, a right of objection and, under certain conditions, a right to data transferability. Furthermore, every data subject has the right to revoke his/her declaration of consent under data protection law and the right to lodge a complaint about the processing of his/her personal data with a supervisory authority.
